These Terms of Service (“Terms”) apply to the website blackadsagency.com and to the services provided by Black Ads Agency, Office F1, Nr. 88, Calea Moșilor, Sector 3, Bucharest, Romania (“we”, “us”, “our”). By using the website or ordering a service, you agree to these Terms. If a separate written agreement or proposal has been signed with you, that agreement takes priority where it differs from these Terms.

1. Our services

We provide advertising services, including campaign setup and management, ad approval support, landing-page and creative reviews, and consulting for advertising on platforms such as Facebook, Instagram, Google, YouTube, TikTok, Snapchat and Pinterest. The exact scope, deliverables and timelines of each project are described in the proposal or order confirmation we send you.

2. No guaranteed results

Advertising platforms review ads using their own policies and systems, which they can change at any time and over which we have no control. We use our experience and best efforts, but we cannot guarantee that any ad, account or campaign will be approved, will stay active, or will reach a particular level of sales, leads or return on ad spend. Any results described on this website are examples and do not promise the same outcome for you.

3. Your responsibilities

  • You confirm that your business, products and services are legal in the countries where you advertise them.
  • You are responsible for the accuracy of the information, claims, creatives and landing pages you provide, and for holding the rights to any content you give us.
  • You remain the owner of your ad accounts, business accounts and pages, and you are responsible for your relationship with each advertising platform, including accepting its terms and policies.
  • You agree to provide the access, information and approvals we need on time. Delays on your side may affect timelines.

We may refuse or stop work for any business or content that we consider illegal, harmful or misleading.

4. Prices and payment

Prices are shown in US dollars unless stated otherwise and are confirmed in your proposal. Setup fees are paid in advance before work starts. Monthly management fees are paid in advance for each month of service. Advertising spend is paid by you directly to the advertising platform and is not included in our fees unless agreed in writing. We may pause work if a payment is overdue.

5. Cancellation and refunds

You can cancel a monthly service by giving us written notice before the start of the next billing period. Fees already paid for work that has been started or completed are not refundable unless your proposal states otherwise or the law requires a refund. If we cancel a service without cause, we will refund any fees paid for work that has not been performed.

6. Confidentiality

We keep your business information, account access and campaign data confidential and use it only to provide the services. We will not share it with third parties except as needed to deliver the work, as described in our Privacy Policy, or as required by law.

7. Intellectual property

The content of this website, including text, graphics, logos and images, belongs to Black Ads Agency or its licensors and may not be copied without our permission. Once you have paid in full, you own the campaign materials we create specifically for you, unless the proposal says otherwise.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, such as lost profits, lost revenue, ad account restrictions or suspensions, or decisions made by advertising platforms. Our total liability for any claim related to a service is limited to the fees you paid us for that service in the three months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Website use

You may use this website for lawful purposes only. You must not attempt to disrupt it, gain unauthorised access to it, or use it to send spam. The information on the website is general and does not replace advice for your specific situation.

10. Changes to these Terms

We may update these Terms from time to time. The version published on this page, with its “Last updated” date, applies from the date it is published. Active projects continue under the Terms agreed when the project started unless we agree otherwise.

11. Governing law

These Terms are governed by the laws of Romania. Any dispute will be handled by the competent courts of Bucharest, Romania, without affecting any mandatory consumer rights you may have.
